If I claim my religion prohibits my face to be shown?

Perfect way to hide the identity of a terrorist isnt it.

ORLANDO, Fla. — A judge ruled Thursday that a Muslim woman can pursue her legal fight to wear a veil for a driver's license photo, despite objections from the state that it jeopardizes public safety.


Judge Ted Coleman denied a state motion to dismiss a lawsuit brought by Sultaana Freeman, whose driver's license was revoked when she refused to replace her photograph with one showing her face unveiled.

Freeman, 34, is suing to get her license back with a photo that hides most of her face, except her eyes, behind a veil known as a niqab.

Freeman wears the veil for religious reasons.

When Freeman applied for a Florida license last year after moving from Illinois, she had no problems getting a license wearing the veil, said her attorney, Howard Marks. It was only after the Sept. 11 attacks that the Florida Department of Motor Vehicles told her to replace the photo, he said.

Jason Vail, an assistant state attorney, argued that having a face visible in a driver's license photo is a matter of public safety since criminals are often identified through such pictures.

This is simple, I think. Legally, they can not make her show her face if her religion prevents her from doing so. On the same hand, driving a car is not a right, so if she chooses not to meet the criteria for driving a car (IE getting a licence) she simply should not be allowed to get one. I don't think this is discrimination, if it really was it would have been under serious contention years and years ago. This is not the first year or even decade where religious muslim americans have lived in this country.

Besides, isn't a licence an identification? How can you carry identification that doesn't ID you?

I have great hope for you :).

Precisely my view on this as well. The state can't make her pose for a photo without her veil. But, the state can prevent her from driving if she does not. Quite right.

I would like to be the thorn in all of your sides but I think the women either shows her face or she don't drive. I bet she can't see things coming up on her sides anyway.

Simple solution: have her pose for the photo without the veil, then attach a little veil on the license that can be discretely checked by security. ;)

Anyone know what our policy on this is for passports?

ack, Art agrees with me. I feel dirty. Can I change my answer? I refuse there to be hope for me!

Hmm... How about this. The concept of driver's licences are stifling to the freedom of motility prized by Americans. This case just don't go far enough, we should ban all driver's licences as the age and ability requirements are discriminatory! There I feel better.

I'm not serious about the above proposal for those who might think otherwise.
