Whats up guys. I made this pretty sweet shirt that reads across "FREE SEAN TAYLOR" Then under in black and white I put on his mugshot that is available many places on the internet. And may I say its a very cool shirt and I plan on selling them however I am just slightly hesitant if I could because it is still Sean's actual picture even though it hsi mugshot. Any help would be greatly appreciated.

You're using his name and likeliness to sell your tshirts.... what do you think?

I obviously know how it works I was just wondering if there was a kind of thing when the picture is in the public domain as is the mugshot-that's really my question.

What you would be doing is something call misappropriation. If Sean Taylor were to discover your activities, he could sue you and would win. That you have created a written record of your knowledge of the possible illegality is not in your favor.

As I understand it, Sean Taylor's name and likeness are protected (specifically, as a member of the NFLPA), regardless of where the picture comes from.

You're a little late. You might want to see if dcsportsfan.com copyrighted the phrase.

Because the picture is in the public domain, it's free, to look at. I think you could give the shirts away and be fine. But once you sell one, you cross the line.

This is correct. You do not have the rights to Sean's likeness. You would need to have a licensing agreement with Players Inc (the NFLPA marketing arm).
With that said...I'd still buy one.

This is actually incorrect. the Players Association only has rights to a players image when more than five players are involved. its called a group licensing agreement and is part of the standard pro player contract in the nfl. however, sean taylor still has all the rights associated with him by himself. so, the players association has no rights to the likeness of sean taylor in a mugshot because it does not contain more than five union players in it.

It wouldn't be hard to find four more.
