View Full Version : Advice Needed: regarding roommate

I moved into a house about 6 months ago. The person that was currently living there was looking for a roommate. That person does not own the home, they just needed someone to help with the rent after their significant other moved out. Anyways, I told them on Oct 20th that id be moving out on Nov 15. I said id prorate Nov. rent, basically half what i usually pay and they said fine. When i moved in we didnt put anything in writing. No lease. No deposit. No notice needed if i were to move out. We also didnt have any verbal agreements. Well the problem is that person is moving out right now and didnt pay Novembers rent to the landlord. My problem is they cashed my rent check. Should i ask for the money back. If theyre not paying rent then why should I. I take it that the landlord said they had such and such time to move out. I know this person and even if the landlord said they owed money for Nov and maybe even for not giving a notice they would never pay it. I havent discussed the situation at all with this person. Just that i was moving out and they said OK. suggestions? thanks

I think legally you're okay as the other guy's name was on everything. You had an agreement with him. He had an agreement with the landlord. Still, a very stinky situation for both you and the landlord to be in.

If you feel like going through the hassle, then you are going to have to get a lawyer... plain and simple.

If you paid via check. I wouldn't, b/c you have proof that you in good faith made payment towards the rent. That further indicates that he's the evil doer.

If you paid the room mate and not the landlord, you should demand your money back because he may not have given your payment to the landlord. Overall, I think you're "F"ed though.You may end up having to cover it all.

Well you didn't enter any formal agreement with anyone so you are technically not liable, however you do have a verbal contract and that is recognized. SO to protect yourself do not ask for the money back as you have proof that in good faith you did what was required of you.

Now the question is if your friend is moving out of the house now, when do you have to be out especially since you technically don't have an agreement with the landlord?
