Over the objections of the world court, the Bush administration, and death-penalty opponents everywhere, the state of Texas executed convicted rapist and murderer José Medellín Tuesday night. Here's the story from The New York Times.
The case drew international attention from critics of the Texas criminal justice system because Medellín, a Mexican national, was not allowed to talk to a consul after his arrest. A 1963 treaty requires foreigners accused of crimes to be given that opportunity.
Medellín was one of six Houston gang members who brutally raped and strangled two girls, Elizabeth Pena, 16, and Jennifer Ertman, 14, as they walked home on June 24, 1993. According to testimony, Medellín said the girls had to die so there would be no witnesses to the gang-rape.
He was 18 at the time of the crime, and 33 when he was put to death.

I think the the US government should hire hitmen to take the ****ers out before they even get to jail. Go ahead and pay them with tax money, Just make sure it's less then it would cost to keep them alive in prison for 20 years.

This sick mother****er should have been forced to drink gasoline and then have it finished it off with a lit match. Though that wouldn't have been a harsh enough punishment for this scumbag to make up for what he and the other animals did to those two girls.

Wow, reading the story of the terrible things those girls went through makes you lose all faith in humanity. That was heart wrenching. I just don't understand why one human being wants to do things like that to another human being.

I find it interesting that Bush was in this guys corner. When he was govenor of Texas, there was a Canadian executed in Texas. Before the execution, the Canadian government and I believe the U.S. government on Canada's behalf requested a stay of exucution. Bush's response was, "If you don't want your Canadian citizens executed in Texas, they shouldn't murder in Texas." He then had the guy killed.

It was wrong, we had an agreement which we should have upheld. Regardless it would not have made a difference. The same result would have occurred.
Real sad what happened to those poor girls. I am a staunch opponent to the death penalty but I have to admit that this guy had it coming.

I'm sorry but there is no other country on the planet that should be telling us what to do with criminals caught in our country. Neither should the Federal Government be telling the states how to punish the criminals convicted of state offenses.

While I agree that this guy was scum and should have been killed no matter what, we definitely have to follow the freedoms and privileges outlined in our treaties, even to someone like this.
The minute we deny anyone these privileges is the minute we lose them for ourselves. If we expect to have these same rights extended to us, we have to extend them as well. He was going to die anyway, it isn't like talking to consul would have changed that. It's just the principle of equal protection under law.

I think the issue here revolves around when this individual came into the country, and whether or not he was under an amnesty program.
If he was an undocumented alien, yes he should have had a token visit with the Consul.

There was a thread about it when they ruled. I think that at least part of their ruling was that most of the defendants who were in the appeal never requested access to the consul. (Although I observed at the time that "most" does not equal "all".)
But I think that the crux of the SC ruling was that the people appealing couldn't prove that if they had been granted consular access, that anything would have been different. (In short, the court ruled that denying then access to consul was illegal, but that the plaintiffs weren't damaged.)
(One of the things I find really ironic about this issue is that Governor W actually made an argument in court, written by Good Buddy Gonzales, that US Treaties don't apply to the State of Texas, because Texas didn't sign the Treaty.)

Why are these Americans outside the US to begin with? If I were to go to some thirs-world country I wouldn't expect to be treated any different than the people living there.

The state of Texas did the right thing, the U.S. backing up this scum bag is in the wrong. He left Mexico and entered this country illegally, at which time, if I remember correctly, he loses any diplomatic immunity. My next question is, what happens to a member of the U.S. in Mexico that does the same crime? Never gets to jail, the cops just kill them there.

One of the basic foundations of the Constitution is that it is the supreme law of the land - any and all treaties signed by the U.S. must be constitutional, and if a treaty is unconstitutional it is void (otherwise the President could sign a treaty disbanding Congress).
That is why Texas told the President and the ICJ to butt out, and why the Supreme Court upheld it.
