TOKYO (Reuters) - Sony Corp. said Monday it was ordered by a U.S. court to halt sales of its blockbuster PlayStation consoles in the key U.S. market and pay $90 million in damages to a small U.S. tech company, Immersion Corp.

Sony Computer Entertainment (SCE), Sony's gaming unit, said it would appeal the decision by a California federal court in the patent infringement case.

For the time being, Sony will keep selling PlayStations because the order -- which covers the PlayStation and PlayStation 2, two game controllers and 47 software titles -- will not go into effect before the appeal, an SCE spokeswoman said. Sony will be paying compulsory license fees to Immersion, she added.

Sony (Research) in January cut its operating profit estimate for this business year by 31 percent, citing sharply falling prices of televisions, DVD recorders and other key products and weak demand for chips.

Immersion, a California-based developer of digital touch technologies, claimed Sony Computer Entertainment infringed on its technology that makes a game controller vibrate in sync with actions in games, the Japanese game maker said.

The $90 million awarded by the court is more than triple Immersion's total revenues of $23.8 million in 2004 and represents two-thirds of the company's current market value of around $135 million.

The court's decision confirmed a ruling by a California jury last year that ordered Sony to pay $82 million in the case. The amount was raised to slightly over $90 million due to interest.

Shares in Sony were down 0.91 percent at ¥4,360 in afternoon trade, underperforming the Tokyo stock market's electric machinery index, which rose 0.35 percent. Immersion's stock last traded on Thursday at $5.75, down 11 cents.

In another intellectual property-related lawsuit between Japanese and U.S. technology companies, Toshiba Corp. was ordered by a California jury last week to pay a total of $465 million in punitive and other damages to Lexar Media Inc. (Research) for stealing trade secrets.

Toshiba, the world's seventh-largest chip maker, suggested it would appeal the decision.

Toshiba shares were down 0.22 percent at 446 yen, extending Friday's 0.45 percent slide.

There is an appeal in progress, but this could be a huge blow to sony and the playstation series.

So... Are we all going to have to get new PS2's that are compatible with their new controller design? Or is this going to force the PS3 release sooner than we all thought (not immediate obviously, as it's still in development)

Not sure i was trying to find out more but i cant seem to get anything except this same general info. If the appeal fails i imagine that the PS2's that are left will sell real quick. I dont know what that would mean for the upcoming ps3 though

if Sony loses, and pay them a fine, will they be able to use the technology? If not, Sony should have fun developing a new technology that works with their controllers.

Steel the idea, dump on the American Market, whine when someone calls you on it.

i've heard of this lawsuit a while ago. i think this company has sued alot of companies including logitech and microsoft. matter of fact i heard the company has essentially gone belly-up and is making its money by suing larger companies.

My bad kind of hard to see this thread with it not being named correctly :D

It sounded like Sony would have to pay the money and create a brand new playstation.

Then if sony wanted to continue selling they would have to work out a new deal with the rights from this company.

This could be why Sony released the portable one faster then they originally wanted, since they knew there was a good shot of losing the lawsuite.

From what I understand, both Microsoft and Nintendo chose to settle out of court and now license the technology from Immersion. Sony chose to fight it.

wtf is up with this xenophobic bs?

Microsoft did the exact same thing with the XBox, but they eventually settled the case.

This is not something Japanese or American, everyone saw a useful technology and tried to develop their own. It just turns out nobody, Japanese or American, managed to create a novel way of doing it, so now they're paying for it.

It's not standard Japanese business practice. It's standard business practice. period. Try to make as much money as you can. What's more American than that?
