    Liable is liable. The court agreeing a publication is liable only pertains to legal action that can be taken.

    If I defame my company, that company could take me to court or they could decide to just fire me. If a company decides to fire me for defamation rather than taking me to court, I have the freedom to challenge that accusation, suing the company for wrongful termination. If they do not have a strong enough case to prove I defamed them I am entitled to compensation.

    This kid has the same right. If he believes he was mistreated because he did not infringe the rights of the teacher, he should sue the school system. And he should be well compensated if he was mistreated.

    If the child's family wishes the decision to be made by a court system, they have the ability to make that happen.

    As a parent, I would much rather my child be expelled rather than be forced to go through the expense of legal action. If my child obviously defamed the teacher and I have no case, I walk away and count myself lucky that legal action wasn't taken. If I believe the schools case is flimsy and that they did not act prudently, I can press my case in court and the school system is now forced to deal with the legalities of their action at my choosing.

    Wierd, that school was the rival to my HS growing up. My parents barn was actually on the border line between the two districts. Small word!

    If you're going to make this a legal matter slander is illegal as well. However how many of us talked about how much we hated certain teachers for X reason. Other teachers heard us but nothing ever happened. Plus they have to prove that all accusations are incorrect or it's not defamitory. Sure they probably shouldnt have made it a facebook page but it's not the bomb that they make it out to be.

    as usual, we don't know the whole story. all of you that say only the courts should determine libel, have you considered that maybe the teacher would've gone that route but gave the kids / parents the opportunity to take this one? i mean, when all is said and done, in 5 years, what does getting kicked out of school mean?

    In a way, it's rewarding the kid... but it's also giving a cool off period, makes the parent who has to take off work miserable and therefore should make the kid's life miserable, and gives a period of relief to the teacher and class who don't have to put up with nonsense for a week or two.

    It loses its efficasy as the kid gets older. I remember being a teacher and the first time I sent a kid to the principal (6th grader) he was freaked out... by seventh grade, he was trying hard to arrange it because it gave him what he wanted and decided it was a badge of honor.

    Showing that there can be consequences for postings made on a public message board? Sounds like a lesson to me.

    i got kicked out of school twice while growing up. my suspensions were anything but a vacation.

    Your point about parents is depressingly accurate. At least it was all too often true when I taught and I doubt it has improved much from what I see and here.

    What gets me is that schools supposed expel students for serious infractions, yet they just transfer to another school where they start more trouble.
