    Actually, the article states that he was still in their cell when they found him so yes, he was still in their "custody" and they were responsible for his health and well being.

    The DEA has now apologized:

    DEA apologizes to college student left in cell

    SAN DIEGO (AP) -- The Drug Enforcement Administration issued an apology Wednesday to a California student who was picked up during a drug raid and left in a holding cell for four days without food, water or access to a toilet.

    DEA San Diego Acting Special Agent-In-Charge William R. Sherman said in a statement that he was troubled by the treatment of Daniel Chong and extended his "deepest apologies" to him.

    The agency is investigating how its agents forgot about Chong.

    Chong, 23, was never arrested, was not going to be charged with a crime and should have been released, said a law enforcement official who was briefed on the DEA case and spoke on the condition of anonymity.

    No. I still find it very hard to believe that the DEA forgot about him in a cell and never checked the cell despite his banging around, screaming, and ripping apart one of the walls of the cell. I find it very hard to believe that they accidentally left drugs in there with him. If the DEA made it a habit to lock up people in sound proofed cells without any means of seeing inside the cell and without searching them I imagine they'd have a lot of dead suspects by now.

    Something about this story doesn't add up.

    I'd guess he carried the drugs into the room in his stomach. Certainly within 5 days they'd have found an exit.

    Sad thing is, he probably ends up getting paid more than people that were wrongly on death row for 15 years

    I'm not buying his entire story, but clearly something did go dreadfully wrong.
